BR judge for second time: Jindal's teacher tenure law is unconstitutional


BATON ROUGE -- A Baton Rouge judge on Wednesday ruled that Gov. Bobby Jindal's teacher tenure law is unconstitutional.

This is the second such ruling on the matter in recent months.

According to The Advocate in Baton Rouge, Judge R. Michael Caldwell of the 19th Judicial District Court, ruled the law unconstitutional in March. The state Supreme Court asked him to review the law once more in light of new case law, however, Caldwell on Wednesday affirmed his earlier ruling. The case now heads to the state Supreme Court.

Rep. James K. Armes, D-Leesville, said he felt the ruling was "good news" for teachers who had concerns about the tenure law.

"It's good news ... actually, nothing has changed. We still have the appeals process but we feel sure the appeal will go our way. I think the governor is starting to count his chickens," Armes said.

Jindal on Wednesday released the following statement to the media:

Jindal said, “We believe it is Constitutional and we are going to appeal  to the Supreme Court. This was the same decision the judge made last time, and we appealed it. The Supreme Court sent it back and asked him to reconsider.  He issued the same decision. We will appeal to the Supreme Court again. The law will continue to be in effect.
“These reforms are constitutional and will help improve Louisiana schools for children and families across the state. The law rewards effective teachers for their hard work and ensures that we have a great teacher in the classroom so that our children have the opportunity succeed."

State Superintendent of Education John White issued this statement:

"Act 1 empowers educators to make decisions not based on politics but based on merit. Last year, the Supreme Court advised Judge Caldwell to reconsider his original determination that the law's format is unconstitutional. As he arrived at the same conclusion as before, we will again appeal to the Supreme Court. We must allow educators to make decisions based on merit over politics."
